The weird link between 23andMe and Anthropic is that the valuable asset is also the obligation. 23andMe Keeps the Liability

23andMe's problem is not that genetic data lost value. It is that the data is valuable enough to make a distressed sale legally messy.

California Attorney General Rob Bonta sued Chrome Holding Co., formerly known as 23andMe, over the company's 2023 breach. The complaint says the attack affected nearly 7 million users across the United States, including 855,541 Californians, after a threat actor accessed about 14,000 accounts and then used the DNA Relatives feature to pull data about far more people. The suit alleges weak security, misleading breach statements, and violations of California's genetic privacy, data security, false advertising, unfair competition, and consumer privacy laws.

Why it matters: The usual corporate defense in a credential-stuffing case is that users reused passwords somewhere else. California's theory is harsher: if a company builds a product around highly sensitive genetic and kinship data, known password-reuse risk becomes a system risk, not merely customer error. That matters because DNA data is not like a credit card number. It cannot be reissued, it reveals family relationships, and one person's disclosure can expose relatives who never made the same security choice.

The DNA Relatives feature is the structural point. 23andMe's network effect made the product better by connecting people to biological relatives, but the same graph made compromise more valuable. California says the attacker moved from a relatively small set of accounts to nearly 7 million people by exploiting that feature and other vulnerabilities, while stolen data was advertised on the dark web with references to AAPI and Jewish users. The liability multiplier was not just data volume; it was sensitive data connected into an identity graph.

That is why the bankruptcy backdrop matters. Bonta's office says this lawsuit is separate from its pending bankruptcy-court challenge over the sale of Californians' genetic information and material. If the state succeeds, the message to buyers is clear: a dataset does not travel cleanly just because the corporate shell changes. Consent promises, breach history, notice obligations, deletion rights, and security failures can follow the asset into the sale process and discount its price.

Room for disagreement: 23andMe can argue that credential stuffing is materially different from a clean break-in, and that customers also bear responsibility for reused passwords. It can also argue that the breach did not expose every class of genetic data it stored. The problem is that California's complaint focuses on what 23andMe knew, how long the attacker stayed undetected, and what the company allegedly told consumers after the fact, which moves the dispute from bad luck to governance failure.

What to watch: Watch whether other state attorneys general join California or file parallel claims using genetic-specific privacy laws rather than generic breach statutes. A multistate case would make genetic datasets harder to finance, sell, or insure on ordinary consumer-internet terms.

Anthropic Finances the Frontier

Anthropic is now being valued less like a software company than like a claim on scarce industrial capacity.

The company raised $65 billion in Series H funding at a $965 billion post-money valuation, backed by a broad syndicate that includes Altimeter Capital, Dragoneer, Greenoaks, Sequoia Capital, Capital Group, Coatue, GIC, ICONIQ, and others. Anthropic says its run-rate revenue crossed $47 billion earlier this month, and that the round includes $15 billion of previously committed hyperscaler investment, including $5 billion from Amazon. The same announcement names Micron, Samsung, and SK hynix as strategic infrastructure partners and says Anthropic has recently signed for up to five gigawatts of Amazon capacity, five gigawatts of next-generation TPU capacity with Google and Broadcom, and GPU access through SpaceX's Colossus clusters.

Why it matters: The headline looks like venture capital. The mechanism looks closer to project finance. Frontier labs are becoming intermediaries between enterprise demand for intelligence and physical supply of chips, memory, power, land, cooling, and cloud capacity. Anthropic is not raising money only to fund engineers and go-to-market. It is raising money to secure the right to serve demand before the constraint moves elsewhere in the stack.

That changes how to read the valuation. A $47 billion revenue run rate is enormous, but the relevant question is cash conversion: how much of that revenue survives the cost of inference, training, memory, power, and cloud commitments? In old software, scale tended to expand margins because distribution was cheap. In frontier AI, scale can also force the company to buy more scarce capacity before the unit economics are fully visible. The round is therefore both proof of demand and evidence of the demand's cost.

The investor list says the same thing. Hyperscalers get anchor AI workloads. Memory suppliers get a clearer line of sight into future HBM and storage demand. Anthropic gets optionality across AWS, Google Cloud, Microsoft Azure, Google-Broadcom TPUs, Amazon capacity, and SpaceX GPUs, even while it says AWS remains its primary cloud provider. The strategic asset is not only Claude. It is the capital stack that keeps Claude available when customers want more tokens than the market can cheaply produce.

Room for disagreement: The skeptical read can go too far. A company crossing $47 billion of run-rate revenue is not a pitch deck with no customers, and enterprise deployment may be durable enough to justify front-loaded capacity spend. If inference costs fall quickly and usage becomes embedded in real workflows, the fixed-capacity bet turns into an operating moat.

What to watch: Watch whether Anthropic's next major disclosure gives gross margin, customer retention, or free-cash-flow evidence. A software-margin story needs unit economics, not only bookings momentum.

The Contrarian Take

Everyone says: 23andMe is a privacy clean-up story, and Anthropic is an AI-demand story. One is about punishing a failed consumer company; the other is about rewarding a breakout AI company.

Here's why that's wrong, or at least incomplete: Both stories are about obligations hiding inside assets. 23andMe's genetic database was supposed to be the durable value left after the consumer business weakened, but California is trying to attach security and consent liabilities to that asset. Anthropic's revenue is supposed to justify a near-trillion-dollar valuation, but every new demand signal pulls forward compute, memory, and power obligations. Even Amazon's KiroRank episode, where workers reportedly chased AI-usage scores until the company shut down the leaderboard, is a warning that measured AI consumption is not the same thing as productive demand. The market is learning to capitalize data. Regulators and finance teams are learning to ask what debt comes with it.
